2. Definitions

“Committee” — The Public Procurement Oversight Committee, the government body responsible for procurement oversight.

“User” — Any individual or entity accessing or using the Site.

“Procuring Entity” — Any government ministry, department, or agency conducting procurement activities.

“Tender Document” — Official procurement documents published by the Committee including bidding instructions, specifications, and contract terms.

3. Use of the Website

The Site is provided for informational purposes related to public procurement oversight and tender opportunities. You agree to use the Site only for lawful purposes and in a manner that does not infringe the rights of others or restrict their use of the Site.

You must not misuse the Site by knowingly introducing viruses, trojans, or other malicious material. You must not attempt to gain unauthorized access to the Site, the server, or any connected database.

4. Tender Document Access and Payments

Access to certain tender documents requires payment of a non-refundable document fee, as specified for each tender. The minimum tender file fee is $1,500 USD.

Payment for tender documents must be made via bank transfer to the Committee's designated bank account. Payment details will be provided upon registration. The Committee is not responsible for delays caused by banking processes.

Upon confirmation of payment, registered users will receive access to download the relevant tender documents. Payment does not guarantee the award of any contract.

5. Foreign Company Eligibility — OHADA

In accordance with the OHADA Uniform Act on Commercial Law, foreign companies wishing to participate in any public procurement tender must be duly registered under the OHADA commercial registry in a member state.

Companies that are not registered under the OHADA Uniform Act are ineligible to participate in public tenders. The Committee reserves the right to verify OHADA registration status and disqualify any bidder that does not meet this requirement.

6. Intellectual Property

All content on this Site, including text, graphics, logos, icons, and software, is the property of the Public Procurement Oversight Committee or its content suppliers and is protected by applicable intellectual property laws. Reproduction, distribution, or modification of any content requires prior written authorization from the Committee.

7. Disclaimer of Warranties

The Site and all information contained herein are provided “as is” without warranty of any kind, either express or implied. While the Committee strives to ensure accuracy, we do not warrant that tender information is free from errors or omissions. Users should verify critical information with the relevant procuring entity.

8. Limitation of Liability

To the fullest extent permitted by law, the Committee shall not be liable for any direct, indirect, incidental, or consequential damages arising from the use of or inability to use the Site, including but not limited to reliance on any information obtained from the Site.

9. Third-Party Links

The Site may contain links to third-party websites. These links are provided for convenience only and do not constitute endorsement. The Committee is not responsible for the content or privacy practices of linked websites.

10. Modifications

The Committee reserves the right to modify these Terms and Conditions at any time. Changes will be effective immediately upon posting to the Site. Continued use of the Site after any modification constitutes acceptance of the revised terms.

11. Governing Law

These Terms and Conditions are governed by and construed in accordance with the laws of the applicable jurisdiction and the OHADA Uniform Act. Any disputes arising from these terms shall be subject to the exclusive jurisdiction of the competent courts.
